1. Agreement to Terms

By accessing or using Matchday ("the Service"), you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not access or use the Service. We may update these terms at any time, and your continued use of the Service following any changes constitutes acceptance of the updated terms.

2. Description of Service

Matchday is a web application that scores past Premier League matches and recommends the best to watch without spoilers, and predicts which upcoming fixtures will be the most exciting to watch. The Service is provided free of charge for personal, non-commercial use.

3. Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement.

4. Intellectual Property

All content, features, functionality, software, code, design, visual elements, and arrangement thereof on the Service are owned by Matchday and are protected by copyright, trademark, trade secret, and other intellectual property laws.

The methods, algorithms, formulas, and scoring systems used to generate match excitement scores, ratings, tiers, and recommendations constitute proprietary trade secrets. You acknowledge that these systems represent significant creative and technical investment.

Premier League team names, logos, and related trademarks are the property of their respective owners and are used for informational purposes only.

5. Restrictions on Use

You agree that you will not:

  • Reverse engineer — Decompile, disassemble, reverse engineer, or attempt to derive the source code of any software, algorithms, scoring methodologies, or systems used in the Service.
  • Use for commercial purposes — Use the Service or any content, data, scores, predictions, or recommendations obtained from it for any commercial purpose without prior written consent. This includes selling, reselling, licensing, sublicensing, distributing, or otherwise making available to any third party any data obtained from the Service.
  • Create derivative works — Create derivative works based on the Service, its content, or its scoring and recommendation systems.
  • Build competing products — Use information, data, or methodologies obtained from the Service to build, enhance, or operate a competing product or service.
  • Aggregate data — Aggregate, compile, or combine data from the Service with data from other sources for commercial purposes.
  • Frame or mirror — Frame, mirror, or embed any part of the Service on another website or application without written consent.

6. Acceptable Use

You agree not to:

  • Attempt to gain unauthorized access to any systems, data, or infrastructure associated with the Service
  • Introduce any malware, viruses, or harmful code
  • Interfere with or disrupt the proper operation of the Service, including through denial-of-service attacks or overloading
  • Circumvent any security measures, rate limits, or access controls
  • Use any automated systems, bots, scrapers, crawlers, or data mining tools to access the Service without express written permission
  • Violate any robots.txt directives or machine-readable access instructions on the Service
  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations

7. Sports Data and Gambling Disclaimer

The Service is intended for entertainment and informational purposes only. Match excitement scores, predictions, and recommendations reflect algorithmic assessments and may not correspond to individual preferences or actual match outcomes.

You may not use the Service, including any scores, predictions, ratings, or recommendations, in connection with gambling, sports betting, or wagering of any kind. Matchday does not provide gambling advice and assumes no responsibility for any wagering decisions.

Match data is sourced from third-party providers. We do not guarantee the accuracy, completeness, or timeliness of any sports data displayed on the Service.

8. Third-Party Content

The Service displays data sourced from third-party sports data providers. While we strive for accuracy, we are not responsible for errors, omissions, or delays in data provided by these third parties. Third-party trademarks, logos, and content remain the property of their respective owners.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS. WE MAKE NO GUARANTEES REGARDING THE ACCURACY, COMPLETENESS, OR TIMELINESS OF MATCH DATA, EXCITEMENT SCORES, OR PREDICTIONS.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MATCHDAY AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

THIS INCLUDES, WITHOUT LIMITATION, ANY DAMAGES ARISING FROM: DECISIONS MADE BASED ON THE SERVICE'S SCORES, PREDICTIONS, OR RECOMMENDATIONS; LOSSES RELATED TO BETTING OR GAMBLING; OR INACCURACIES IN DATA FROM THIRD-PARTY SOURCES. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR LIMITATION OF LIABILITY, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

11. Indemnification

You agree to indemnify, defend, and hold harmless Matchday and its operators from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any rights of any third party.

12. Termination

We reserve the right to restrict, suspend, or terminate your access to the Service at any time, without notice, for any reason, including but not limited to violation of these Terms. The provisions regarding Intellectual Property, Restrictions on Use, Disclaimer of Warranties, Limitation of Liability, and Indemnification shall survive any termination.

13. Governing Law

These Terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

14. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
